Unfortunately the judiciary still inhabits the Victorian ages when it comes to their understanding of employment and also what contractors and freelancers are… HMRC is even further behind, perhaps stuck in the dark ages.
In fact, the behaviour described is closer to a franchise than an ’employer’ relationship.
As a victim of IR35, I know that the state will take whatever view suits itself on such issues.
